MACHINERIC PLATFORM PRIVACY POLICY

Machineric Solutions OÜ (“Machineric”, “we”, “us” and “our”) collects data about users and visitors to our website at www.machineric.com and our mobile applications, such as for iOS or Android (the “Machineric Platform”). This helps us to enable the provision of the Services pursuant to the Machineric Platform Terms and Conditions for Use (the “Services”), and to improve the user experience on the Machineric Platform. Machineric’s personal data processing practices are governed by the following Privacy Policy (the “Privacy Policy”), which provides you with information on personal data that Machineric collects, how we use that data, who has access to that data etc. The Privacy Policy also describes your rights as a data subject.

Machineric complies with the provisions of General Data Processing Regulation (EU) 2016/679 and the national legislative acts with regard to the processing of personal data.

  1. PERSONAL DATA WE COLLECT AND HOW WE USE IT

In this Privacy Policy, “personal data” is defined as any information relating to an identified or identifiable natural person.

  • Subscription and account information

When you as a representative of our client purchase a subscription to the Machineric Platform (“Machineric Subscription”) to use the Machineric Platform and our Services, or when you use the Machineric Platform based on the Machineric Subscription purchased by your employer, we will collect personal data as necessary to provide the Services you request. We may require you or your employer to provide us with your name, mobile phone number, e-mail address, username, employer and position and selected password to establish an account on the Machineric Platform. We may require you to provide us with additional personal data to provide you additional services. We also process information about your user rights on the Machineric Platform.

The purpose and legal basis to collect these data is our legitimate interest to provide our clients with the requested Services.

  • Transaction information

When you purchase a Machineric Subscription, we collect information about your payments and transactions, as well as other information associated with the transaction such as used payment method or other important information.

Legal basis to collect and process transaction information is our legitimate interest to execute a contract between us and our customers, as well as to provide our Services. We also process these personal data to fulfil our obligations under applicable accounting and tax laws. In these cases, the processing of personal data is based on mandatory legal provisions which require that we store certain data for accounting purposes.

  • Data about your use of the Machineric Platform

We always improve the Machineric Platform and user experience. Therefore we have to know what information on the Machineric Platform is most interesting for visitors, from which countries visitors come to the Machineric Platform, how often visitors return, which browsers they use, on which devices the Machineric Platform is browsed, what is their IP address, how you move, click or scroll around our the Machineric Platform etc.

As you navigate through the Machineric Platform, certain information can be collected without you actively providing the information using various technologies, such as cookies, Internet tags or web beacons, and navigational data collection (log files, server logs, clickstream, website scripts). Your internet browser or mobile device automatically transmits some of this information, such as the URL of the website you browse or just came from and the Internet Protocol (IP) address and the browser version your computer or mobile device is currently using; the date and time you access the Machineric Platform and the pages that you access while visiting the Machineric Platform.

Legal basis to collect that data is necessity to perform our service to provide you with Machineric Platform and our legitimate interest to improve it.

  • Inquiries and answers

When you contact us with an enquiry via the Machineric contact form at www.machineric.com/contact and/or on our mobile applications, or contact us via e-mail or phone, we will process your contact details and content of your message to respond to your enquiry.

Legal basis to collect this data is our legitimate interest to respond to enquiries about us and our services.

  • Direct marketing

If you subscribe to receive mobile applications’ push notifications  and/or e-mail communication from us on the Machineric Platform by providing your e-mail address and you consent to receive news and/or push notifications, we may use mobile applications’ push notifications and/or your e-mail address for the purpose of sending you updates, offers and other marketing material.

Legal basis to provide you with direct marketing material is your consent to advertise and grow the sales of Machineric and to provide you with relevant information about Machineric and offers of Services available at the Machineric Platform. You may disagree with such use of your e-mail at any time by clicking “unsubscribe” in the message you receive from us.

  • Data regarding legal claims

If necessary, we may process your personal data in order to establish, exercise or defend legal claims arising out of or in relation to the agreement between us and you (or the company you represent).

What are cookies?

A cookie is a small data file that may written to your device when you browse the Machineric Platform. A cookie enables the Machineric Platform to remember your actions and preferences over a period, so you don’t have to keep re-entering them whenever you come back to the site or browse from one page to another.

What cookies do we use?

The Machineric Platform uses cookies to collect your IP address and browsing information, such as the websites you have visited or time you have spent on each page and allow the Machineric Platform to remember your system and preferences.

How long are cookies retained on my device?

We put our best efforts to keep your data safe and always require the high level of security and confidentiality from our employees and partners.

However, if we do so, we use adequate safeguards to protect your personal data, such as the standard contractual clauses for transfers established by the European Commission.   1. RETENTION OF YOUR PERSONAL DATA

We process your personal data only for as long as necessary for the fulfilment of the purposes of personal data processing, which are described above.

Most of your personal data will be kept until the end of the contractual relationship with us, i.e. until your account is active. However, we may keep some of your personal data for longer, if this is necessary to achieve our legitimate interests or where this is required by law. For example, we keep accounting source documents (such as contracts and invoices) for 7 years as of the end of the financial year when a business transaction was recorded in our ledgers. Personal data relating to contractual relationships may be kept for up to 10 years after the end of the contractual relationship, taking into account the maximum expiry period of claims.

In some cases, personal data may be stored for a longer period if storage of personal data is required in order to protect our or any third parties’ legitimate interests, e.g. in case of a legal dispute.

When the retention of your data is no longer necessary to achieve the purposes of processing, your data will be permanently removed, unless you instruct us otherwise and we agree on the terms on longer storage of your data.

  • You may request access your personal data;
  • To the extent allowed under applicable law, you may request us to correct, update, change or remove your personal data at any time;
  • If you request the erasure of your personal data, please note that certain information is strictly necessary in order to fulfil the purposes defined in this Privacy Policy and may also be required by law. If personal data is erased under your request, we will only retain such copies of the information as are necessary for us to protect our or third parties’ legitimate interests, comply with governmental orders, resolve disputes, troubleshoot problems, or enforce any agreement you have entered into with us. Thus, you may not erase such personal data;
  • The right to withdraw consent regarding processing of personal data, where the legal basis for processing is your consent;
  • The right to data portability (to the extent allowed under applicable law);
  • In some cases you may have a right to request restriction of processing of your personal data or to object to processing of your personal data.

If you think there is a problem with the way we are handling your personal data, you have a right to file in a complaint to your national data protection authority in the EU/EEA.
